GENERAL TERMS & CONDITIONS
1. Scope
These General Terms and Conditions ("T&C") govern all services and offers provided by Mobiles Chiptuning, owner Christopher Laiber-Gödl ("Provider"), to customers ("Customer"). Deviating conditions of the Customer are only accepted if expressly agreed in writing.
2. Services
The Provider offers engine control unit (ECU) software optimisations, including:
- Performance and torque optimisation (Stage 1 to Stage 2+)
- Eco-tuning for improved fuel efficiency
- Software modifications (e.g. DPF, EGR, AdBlue deactivations)*
- Individual vehicle coding and custom adjustments
Services are performed by reading and writing the vehicle's ECU via the OBD2 port or, where required, via direct ECU communication (bench/boot mode).
3. Customer's Obligations
The Customer is obliged to:
- provide complete and accurate vehicle information (make, model, year, engine, displacement, current mileage)
- ensure the vehicle is in technically sound condition and free of active fault codes at the time of service
- disclose any known prior damage, modifications or previous tuning work
The Customer is solely liable for any damage arising from incorrect or incomplete information.
4. Vehicle Condition
The Customer confirms that the vehicle is in technically perfect condition at the time of the software optimisation. Existing wear parts or defects (e.g. turbocharger, clutch, injectors, particulate filter, gearbox) may be subjected to greater stress as a result of increased performance. The Provider accepts no liability for damage caused by pre-existing defects.
5. Motorsport & Export Notice
6. Liability
All work is carried out to the best of the Provider's knowledge and ability. Liability for damage to the vehicle, engine, gearbox or other components is excluded to the maximum extent permitted by law. The Provider is not liable in particular for:
- consequential damages of any kind
- engine or gearbox damage
- increased wear resulting from higher performance
- damage caused by pre-existing defects or prior damage
7. Warranty
Software modifications may void the vehicle manufacturer's warranty or guarantee claims. The Customer acknowledges this and accepts the associated risk.
8. Prices & Payment
All prices are final prices. As a small business operator (§ 6(1)(27) UStG), no VAT is charged. Payment is due before the service is rendered. Accepted payment methods:
- Cash (on-site)
- PayPal
- Bank transfer (by arrangement)
9. Digital Services & Right of Withdrawal
10. Intellectual Property
All tuning files and software solutions created by the Provider remain its intellectual property. Sharing, reproduction or resale without prior written consent is strictly prohibited.
11. Self-Installation Responsibility
If the Customer installs the software independently using a flash tool or OBD device, this is done entirely at their own risk. The Provider is not liable for damage caused by faulty flash hardware, voltage drops, connection interruptions or operator error.
12. Vehicle Registration & Emissions
The Customer is solely responsible for ensuring that their vehicle continues to comply with all applicable registration and emissions regulations after any software modification. Modifications may affect exhaust emissions, operating permit, type approval and insurance cover.
13. No Performance Guarantee
Stated performance gains are indicative values. Actual results may vary depending on vehicle condition, fuel quality, ambient temperature and individual vehicle tolerances. The Provider does not guarantee the achievement of specific performance figures.
14. Governing Law & Jurisdiction
These T&C are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The court of jurisdiction is the competent court at the Provider's registered office (Styria, Austria).
15. Severability
Should any provision of these T&C be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original.
